The following vehicles were Customer ordered tows and no one has claimed these vehicles as of 08/11/06. There is a lien on these vehicles for towing and storage charges and any additional storage or costs from the date of this notice. Upon reading the petition of the Plaintiff herein for the appointment of Matthew M. McGuire, Esquire, as Guardian Ad Litem Nisi for unknown infant defendants and persons under disability or in the military service, if any, herein, collectively designated as Richard Roe and Jane Roe for the purposes of said action, and by and with the consent of the said Matthew M. McGuire, Esquire and it appearing that the names or addresses of said infants or others under disability or in the military service, incompetents, or persons in prison, if any, whether residents or non-residents of this State are unknown to the Plaintiff and cannot with reasonable diligence be ascertained, and the said Matthew M. McGuire, Esquire is suitable and proper person to protect the rights of said infant defendants and others under disability or in the military service, if any, in said action and he has no interest therein adverse to said infant defendants, or others under disability or in the military service, incompetents or persons imprisoned, and is not connected in business with Plaintiff in this action, or his counsel.

NOW THEREFORE, IT IS ORDERED that the said Matthew M. McGuire, Esquire, be and is hereby designated and appointed Guardian Ad Litem Nisi for such unknown infant defendants and persons under disability or in the military service incompetents or persons imprisoned, if any, collectively designated as Richard Roe and Jane Roe, and he is authorized to appear and defend said action on behalf of said infants or persons under disability or in the military service, incompetents or persons imprisoned, if any, or someone on their behalf shall within thirty (30) days after service of the Notice of this Order upon them as herein provided, procure the appointment of a Guardian Ad Litem for the said infants or persons under disability or in the military service, incompetents, or persons imprisoned, if any, to this action.

IT IS FURTHER ORDERED that a Notice of this Order shall be served upon the unknown minor defendants and persons under the disability or in the military service, incompetents, or persons imprisoned, if any, herein collectively designated as Jane Roe and Richard Roe by publication of a Notice of this Order, as required by the law in the Columbia Star, a newspaper published in Richland County, South Carolina, once a week for three (3) consecutive weeks.

YOU ARE HEREBY SUMMONED and required to answer the Complaint herein, a copy of which is herewith served upon you, or to otherwise appear and defend, and to serve a copy of your Answer to said Complaint upon the subscribers at their office, 3955 Faber Place, Suite 200, P.O. Box 71727, North Charleston, South Carolina, 29415, or to otherwise appear and defend the action pursuant to applicable court rules, within thirty (30) days after service hereof, exclusive of the day of such service; except that the United States of America, if named, shall have sixty (60) days to answer after the service hereof, exclusive of such service; and if you fail to answer the Complaint or otherwise appear and defend within the time aforesaid, the Plaintiff in this action will apply to the Court for relief demanded therein, and judgment by default will be rendered against you for the relief demanded in the Complaint.

YOU ARE FURTHER SUMMONED AND NOTIFIED to apply for the appointment of a guardian ad litem within thirty (30) days after the service of this Summons and Notice upon you. If you fail to do so, application for such appointment will be made by the Plaintiff.

YOU WILL ALSO TAKE NOTICE that pursuant to Rule 53(b) SCRCP, as amended effective September 1, 2002, the Plaintiff will move for a general Order of Reference to the Master in Equity for Richland County, which Order shall, pursuant to Rule 53(b) of the South Carolina Rules of Civil Procedure, specifically provide that the said Master in Equity is authorized and empowered to enter a final judgment in this action. If there are counterclaims requiring a jury trial, any party may file a demand under rule 38, SCRCP and the case will be returned to the Circuit Court.
