S.C. Voters' Bill of Rights

This summary of voting laws was prepared by local law student members of Just Democracy.

+ No one is allowed to intimidate you in order to control how you vote. S.C. Code 7-25-190

+ If you did not provide proof of address when you registered to vote, you have the right to provide it at the polls. When you vote for the first time, you must provide a photo ID or a current bill showing your address if you did not provide it already. 42 U.S. Code 15483

+ You have the right to vote if you are in line when the polls close at 7 p.m., or at any other time between 7 a.m. and 7 p.m. S.C. Code § 7-13-60 and 7-13-850

+ If your right to vote is challenged, you have the right to vote by provisional ballot, as long as you present a valid S.C. driver's license OR registration card. § 7-13-710 and 7-13-830

+ If you lose or deface your registration card, you have the right to request and receive another registration card from your county board of registration. 7-13-710

+ If your ballot does not reflect your choice, do not cast the ballot. You have the right to receive another ballot after returning the spoiled ballot to election officials. 7-13-790

Change of Address

+ If you have moved within the same precinct, you have the right to vote at that precinct after you verify your current address, such as by providing a current utility bill. 7-5-440(A)

+ If you have moved to another precinct or to another county, you have the right to vote, either by provisional ballot at your former precinct or at the main voter registration office in the county where you live now (your choice). You must provide written verification of your current address, such as a current utility bill. 7-5-440(B)

+ If the registration book inaccurately indicates that you have moved away from an address in the precinct, you have the right to vote after you verify your current address, such as by providing a current utility bill. 7-5-440(C)

Disability

+ If you cannot read or write, or you are physically disabled, you have the right to receive assistance with voting. § 7-13-710 and 7-13-770

+ If you are unable to stand in line at the polling place because you are elderly or physically disabled, you have the right to vote in your vehicle outside the polling place. 7-13-771

+ If you are physically disabled, you have the right to vote at your county's Countywide Barrier-Free Voting Precinct if you request and receive authorization to do so thirty days before Election Day. 7-7-990(A)

Criminal Conviction

+ If you have been convicted of a crime but have completed your sentence (including any period of probation or parole), you have the right to vote. 7-5-120(B)(3)
