Plaintiff complaining against the Defendant alleges as follows:

1. That Plaintiff is a resident and citizen of York County, South Carolina.

2. That Defendant is a resident and citizen of Richland County, South Carolina.

3. That this court has jurisdiction and venue over the matters contained herein.

3. That on or about December 10, 2003, on or about 5:50 p.m.. Plaintiff was the driver of a vehicle which was at a complete stop in traffic traveling west on Interstate 526, in the City of North Charleston, County of Charleston, South Carolina.

4. That on or about the aforementioned date, at the said time and place Defendant was the driver of a vehicle also proceeding west on Interstate 526, when suddenly and without warning. Defendant negligently, carelessly, recklessly, failed to slow down and stop for traffic stopped in front of him, thus causing the vehicle which he was driving to run into the rear of the vehicle behind the vehicle in which Plaintiff was driving with force and violence, causing injuries and damages to Plaintiff as hereinafter set forth.

5. That the aforementioned collision was directly, solely and proximately caused by the negligence, carelessness and recklessness of Defendant.

6. That by reason of the negligence, carelessness and recklessness of Defendant, and as a direct and proximate result thereof, Plaintiff has been injured and has suffered and will continue to suffer damages in the following respects:

Plaintiff has sustained injuries in and about various parts of his body including, but not limited to, his head, jaw, neck, back, spine, ribs and lower extremities, which has caused him to suffer and endure considerable pain and discomfort; he has been compelled to expend diverse sums of monies for hospitalization, medical treatments, dental treatments and for the services of doctors under whose care he has been and under whose care, upon information and belief, be compelled in the future; he has upon information and belief suffered from a permanent injury and will upon information and belief be compelled to expend additional diverse sums of monies for the treatment required therefrom; he has suffered a potential loss of earnings and a potential loss of earning capacity; he has been and will continue to be prevented from attending to his ordinary affairs and duties; he has been and will continue to be deprived of the normal enjoyments of life he otherwise would have; and he will continue to have to endure discomforting pain and suffering which he otherwise would not have; and he has been otherwise injured, all to his damage.

WHEREFORE, Plaintiff prays for judgment against Defendants for actual damages in such an amount as shall fairly, justly, and adequately compensate him for his losses, and for such punitive damages as the Court may deem just and proper.

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending in this court upon Complaint of the above-named Plaintiff against the above-named Defendants for foreclosure of a certain mortgage of real estate given by Donna Bumgarner to First Franklin A Division of Nat. City Bank of Indiana, in the amount of $ 64,000.00 dated October 27, 2005, and recorded in the Office of the Register of Deeds for Richland County in Book 1118 at Page 427 on November 4, 2005.

The premises covered and affected by the said mortgage as by the foreclosure thereof, were, at the time of the making thereof, and at the time of the filing of this Notice, described as follows:

All that certain piece, parcel or lot of land, with improvements thereon, situate, lying and being near the City of Columbia, County of Richland, State of South Carolina being shown and delineated as Lot 9 Block U on a plat of a portion of Meadow Lake Hills prepared by Palmetto Engineering Company Inc., dated 01/05/1973 and revised 04/02/1976, recorded in the Office of the RMC for Richland County in Plat Book X at Page 6007; said property being further shown on a plat prepared for John C. Pearson Sr. and Edith M. Pearson by Cox and Dinkins Inc., dated 09/16/1998 and recorded 09/22/1998 in Book 184 at Page 255.
