MASTER'S SALE 05-CP-40-5699

By virtue of a decree heretofore
granted in the case of Lions
Gate Horizontal Property
Regime, Inc. AGAINST
Christopher O'Berry and
Mortgage Electronic
Registration Systems, Inc., as
nominee for 1st Choice
Mortgage/Equity Corp. of
Lexington, I, the undersigned
Master in Equity for Richland
County will sell on Monday,
July 2, 2007, at 12 o'clock noon,
at the Richland County
Courthouse, Richland County
Judicial Center, 1701 Main
Street, Columbia, South
Carolina, to the highest bidder:
All that certain piece, parcel, or
lot of land, with improvements
thereon, lying being and situate
in the County of Richland, State
of South Carolina, the same
being designated as Dwelling
Number 107, in Lionsgate
Horizontal Property Regime,
which regime was established
by Lions Gate, a partnership,
pursuant to the South Carolina
Horizontal Property Act, (1962
South Carolina Code, as amended
Section 57-494 et seq.) Stage
1 of which was submitted to the
Regime by Master Deed dated
October 28, 1974, and recorded
on October 28, 1974, in the
ROD office for Richland County
in Deed Book D331 at Page 868.
Said Master Deed has been
amended as follows:
Amendment Number 1, dated
July 30, 1976, recorded in Deed
Book D392 at Page 972,
Amendment NO. 2, dated
January 25, 1977, recorded in
Deed Book D413 at page 518.
This Dwelling is shown on As-
Built Plat of Stage I, Lions Gate
Condominiums, by Palmetto
Engineering Company, Inc.,
dated September 5,1974,
revised by Palmetto
Engineering Company, Inc.,
Dated September 18, 1974, and
recorded in the ROD office for
Richland County in Plat Book
"X" at Page 2878.
This plat was further revised on
November 24, 1974 "To Show
Location of Tennis Courts," and
on December 9, 1975, to show
total land area in Stage I which
plat so revised is recorded in
the ROD office for Richland
County in Plat Book "X" at Page
6129. Said revised plat was further
revised January 10, 1977
to show exclusion of 0.024 acres
quit- claimed by all co-owners to
The First Service Corporation of
S.C. by Amendment No 2,
referred to above, which revision
is recorded in Plat Book
"X" at Page 7330.

TERMS OF SALE: The successful
bidder, other than the
Plaintiff, will deposit with the
Master in Equity, at the conclusion
of the bidding, Five per
cent (5%) of the bid in cash or
equivalent, as evidence of good
faith, same to be applied to the
purchase price in case of compliance,
but to be forfeited and
applied first to costs and then to
Plaintiff 's debt in the case of
non-compliance. Should the last
and highest bidder fail or refuse
to make the required deposit at
time of bid or comply with the
other terms of the bid within
twenty (20) days, then the
Master in Equity may resell the
property on the same terms and
conditions on some subsequent
Sales Day (at the risk of the
said highest bidder.)
No personal or deficiency judgment
being demanded, the bidding
will not remain open after
the date of sale, but compliance
with the bid may be made
immediately.
Purchaser pay for preparation
of the Master deed, documentary
stamps on the deed, recording
of the deed, and interest on
the amount of the bid from date
of sale to date of compliance
with the bid at the maximum
legal rate for judgments.
Sale of the property will be
made subject to that certain
mortgage on the property, executed
on January 21, 2005, in
favor of Mortgage Electronic
Registration Systems, Inc., as
nominee for 1st Choice
Mortgage/Equity Corp. of
Lexington in the original principal
amount of Sixty-Five thousand
Four Hundred Fifty Five
and No/100 ($65,455.00)
Dollars, Recorded on February
9, 2005, in Book 1022 at Page
2533 in the Office of the
Register of Deeds for Richland
Couonty, South Carolilna, Said
mortgage being senior and
superior to the Line being forecclosed
upon.
Subject to assessments,
Richland County taxes existing
easements, easements and
restrictions of record, and other
senior encumbrances, if any.
